Fire safety

In order to register your tourist accommodation with Brussels Economy and Employment, you have to prove that your establishment complies with the fire protection standards.
 
Do you want to run homestay accommodation, furnished tourist accommodation or a tourist residence?
In certain cases, you have to apply for a simplified inspection certificate.
Do you want to run a hotel, an aparthotel, a social tourism accommodation centre or a campsite?
You have to apply for a fire safety certificate.

Simplified inspection certificate

Candidate operators of homestay accommodation, furnished tourist accommodation or a tourist residence have to prove that this accommodation complies with the fire protection standards. They can apply for a simplified inspection certificate (rather than a fire safety certificate) on two conditions:
- the operator does not run more than five accommodation facilities at once and
- the maximum (combined) capacity of the accommodation is less than 10 people.
 
The maximum capacity is the number of people for which the establishment is designed, plus the number of tourists who can be accommodated on extra beds.
The combined capacity is the sum of the maximum capacities of the tourist accommodation facilities located within the same building.
 
If these two conditions are not met, the operator has to apply for a fire safety certificate.

The simplified inspection certificate demonstrates the compliance of your electrical installation, your heating installation and your gas installation and pipes.

Application for a simplified inspection certificate

Send an application by recorded delivery to the mayor of the commune in which the accommodation is located. Your submission must include: 
  • PDF an application form for a simplified inspection certificate (Available from the moment this regulation enters into force);
  • certificates of conformity issued by an approved body for the tourist accommodation establishment, concerning:
- the electrical installation
- the heating installation, including the chimneys and the flue pipes
- if appropriate, the gas installation and pipes, including the connected appliances.
 
These certificates must have been issued less than two years before the date on which the application for the simplified inspection certificate was submitted and no major conversion work may have been carried since the certificates were issued.
 
Your documents may be accompanied by a letter.

The mayor will decide whether or not to grant you the certificate on the basis of the analysis of your dossier.
If your application is rejected, the mayor will inform you of the possible means of appeal.

Renewal of a simplified inspection certificate

You should use the same procedure to apply for the renewal of your certificate:
  • every five years.
    Tip: Apply for the renewal six months before the expiry date.
  • as soon as the conditions entitling you to a simplified inspection certificate are no longer met
  • as soon as the building or the equipment it contains has undergone transformations likely to call into question its fire safety: creation of new premises intended for tourists, such as bedrooms or kitchens; any transformation requiring an urban planning permit; installation or modification of the gas pipes or appliances and fixed LPG tanks; installation or modification of gas flue pipes of heating appliances; installation, modification or extension of an electricity network, etc.

Fire safety certificate

The fire safety certificate confirms that your establishment complies with the specific fire safety standards applicable for tourist accommodation establishments. These safety standards concern both the various rooms in the establishment and the access routes, indoor and outdoor staircases, the technical areas, parking facilities, electrical, lighting and heating installations, etc.

Application for a fire safety certificate

Send your application or applications by recorded delivery to the mayor of the commune in which your accommodation is located, using the following form:

  • This document may be accompanied by a letter.

Note: you have to submit an application for a fire safety certificate for each category of accommodation run in your establishment. These applications are examined jointly.
 
Further to your application, the Service d'Incendie et d'Aide Médicale Urgente (Fire and Emergency Medical Service) of the Brussels-Capital Region visits your accommodation. They then submit a report to the mayor of the commune where your accommodation is located. On the basis of this opinion, the mayor decides whether or not to grant you the certificate.
 
If your application if refused, the mayor informs you of the possible means of appeal.

Renewal of a fire safety certificate

You should use the same procedure to apply for the renewal of your certificate:
  • every five years (tip: Apply for the renewal six months before the expiry date).
  • as soon as the building, part of the building or equipment in the building has undergone transformations likely to call into question its fire safety:  creation of new premises intended for tourists, such as bedrooms, meeting rooms, kitchen, living room; modification or reorganisation of evacuation routes; major conversion work on the lift or service lift; any transformation work requiring an urban planning permit, etc.
