Exemptions from the work permit obligation

Nationals of the European Economic Space and Switzerland do not need a work permit to be able to work in Belgium. This is also the case for some categories of workers, if they are staying in Belgium legally [1].

 

Nationals of the European Economic Space and Switzerland

Foreign nationals do not need a work permit if they are natives of the following countries: Germany, Austria, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Norway, Netherlands, Poland, Portugal, Czech Republic, Roumania, United Kingdom, Slovakia, Slovenia, Sweden, Switzerland.

Specific categories of workers staying legally

Foreign nationals do not need a work permit if they are staying legally in Belgium and belong to one of the specific workers categories listed in article 2 of the Royal Decree of 9 June 1999 executing the Act of 30 April 1999 on the employment of foreign nationals.

  • This exemption is a right, which means that neither employer nor worker needs to complete any formalities or obtain any certificate.
  • The employer must check to ensure that the foreign national fulfils the exemption conditions. If so, the employer is entitled to hire the foreign national immediately. In some cases declaration of arrival is demanded.
  • A declaration of arrival is required for three categories:

Workers authorised to stay indefinitely

Foreign nationals with a permanent residence permit for Belgium for an unlimited period are automatically exempt from the work permit obligation (Art. 2.3, Royal Decree of 9 June 1999).
