Single permit application

Long-term resident working in a scarcity profession - more than 90 days in Belgium

(art. 9,20 royal decree 09/06/1999)

 

If the duration of the employment in Belgium exceeds 90 days (in case of successive jobs without any interruption, the previous periods are taken into account to calculate the 90 days), you need to submit the following documents:

  1. Form
    PDF Authorisation application for an employment of more than 90 days for a foreign worker - Employer in Belgium - Single permit (in French or in Dutch
  2. Medical certificate of the Immigration Office for a foreign worker (in French or in Dutch)
  3. Other required documents

What is the procedure?

The employer completes an application for a work permit to employ a worker under the single permit scheme. He forwards it to Brussels Economy and Employment. If the application is acceptable and admissible: Brussels Economy and Employment examines the application with regard to the conditions of employment. A) If Brussels Economy and Employment refuses the request: Brussels Economy and Employment notifies its decision to the employer and, if applicable, to the worker who is legally resident in Belgium. The employer and, where applicable, the worker have 30 days from the notification of refusal to lodge an appeal. B) If Brussels Economy and Employment agrees: the Migration Service examines the file with regard to the conditions related to the stay. If the Migration Service gives its agreement:it notifies the worker and issues a single permit. If the worker is in Belgium, he or she is invited to go to his/her commune of residence to receive his/her single permit. If the worker is abroad, he or she is invited to go to the embassy/consulate to apply for a visa and come to Belgium. Once in Belgium, the worker will collect his single permit in his commune of residence.

The procedure takes four months at most from the moment Brussels Economy and Employment has the complete file until the single permit is delivered / the rejection is notified.
